UNLESS PROHIBITED BY LAW, IF THERE IS LIABILITY ON THE PART OF THE COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND IN NO EVENT WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. 9. Applicable law
These Terms are governed and interpreted in accordance with the laws of Israel, which apply to the Agreement without regard to its conflict of laws provisions.
The fact that we do not enforce a right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
10. Waiver and severability
No waiver by the Company of any term or condition set forth in the Terms will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under the Terms will not constitute a waiver of that right or provision.
If any provision of the Terms is found by a court or other competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent so that the other provisions of the Terms will remain in full force and effect.
